{"id":53972,"date":"2025-03-28T10:52:19","date_gmt":"2025-03-28T09:52:19","guid":{"rendered":"https:\/\/www.rplt.it\/third-party-litigation-funding-tplf-european-commission-study-published\/"},"modified":"2025-03-28T10:52:19","modified_gmt":"2025-03-28T09:52:19","slug":"third-party-litigation-funding-tplf-european-commission-study-published","status":"publish","type":"post","link":"https:\/\/www.rplt.it\/en\/third-party-litigation-funding-tplf-european-commission-study-published\/","title":{"rendered":"Third-Party Litigation Funding (TPLF): European Commission Study Published"},"content":{"rendered":"<p>Last March 21, the European Commission <a href=\"https:\/\/commission.europa.eu\/strategy-and-policy\/policies\/justice-and-fundamental-rights\/civil-justice\/civil-and-commercial-law\/third-party-litigation-funding-tplf_en?prefLang=it\">published the study<\/a> requested by the European Parliament on the state of the art of TPLF in the European Union and certain other countries (Canada, Switzerland, the United Kingdom and the United States).<\/p>\n<p>The research, based on national reports, interviews, and stakeholder consultations, provides a comprehensive picture of current regulations and practices and aims to inform the European Commission&#8217;s future policy decisions on TPLF, in particular on the follow-up to the European Parliament&#8217;s <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/IT\/TXT\/HTML\/?uri=CELEX:52022IP0308\">resolution of September 13, 2022<\/a> with recommendations to the Commission on responsible private funding of litigation (2020\/2130(INL)).<\/p>\n<p><strong>General Overview of TPLF in the European Union<\/strong><\/p>\n<p>The report points out that, in most Member States, <strong>there is no specific regulation of TPLF<\/strong>, with the exception of provisions implementing Directive (EU) 2020\/1828 on representative actions for the protection of the collective interests of consumers. Although TPLF is generally not prohibited (with the exception of Ireland), a significant proportion of stakeholders at the European level believe <strong>regulation is necessary<\/strong> to ensure transparency and avoid conflicts of interest. <\/p>\n<p><strong>Focus on Italy: an emerging market without regulation<\/strong><\/p>\n<p>As for Italy, the study outlines a <strong>TPLF market that is still in the development phase<\/strong>. The study highlights the following findings: <\/p>\n<ul>\n<li><strong>Absence of specific regulation<\/strong>: Currently, <strong>there is no legislation in Italy that directly regulates TPLF<\/strong>. Its validity is based on general principles of contract and procedural law. There are also no specific legislative plans on the subject.  <\/li>\n<li><strong>Growing use<\/strong>: TPLF is mainly used in commercial, <strong>financial, and securities litigation<\/strong>, especially in complex and expensive cases. There is <strong>growing interest in its use in mass tort claims<\/strong> (product liability, antitrust damages). <\/li>\n<li><strong>Lack of statistics<\/strong>: <strong>No reliable statistics are available on TPLF in Italy<\/strong>. The market is considered emerging and small, with a limited number of active players. <\/li>\n<li><strong>Administrative supervision<\/strong>: <strong>Administrative supervision is still under development<\/strong>. In general, TPLF is allowed, but there is a lack of dedicated supervisory regulation. However, funder operating as a \u2018<strong>Societ\u00e0 di Investimento a Capitale Variabile<\/strong>\u2019 (SICAV) are subject to supervision by Consob and the Bank of Italy. To date, it appears that only one <em>funder<\/em> operates under this legal form. In contrast, the Supreme Court has ruled that companies that acquire rights and litigious claims <strong>are not subject to the registration requirement of Article 106 of the \u2018Testo Unico Bancario\u2019 (TUB)<\/strong>. An in-depth discussion of the jurisprudential issue is available <a href=\"https:\/\/www.rplt.it\/litigation-funding-registro-tub\/\">at this link<\/a>.     <\/li>\n<li><strong>Limited compatibility with European measures<\/strong>: The absence of specific regulation implies limited <strong>compatibility with the measures proposed by the European Parliament resolution<\/strong>, with the exception of financial regulation applicable to SICAVs and general principles of civil law governing financing contracts.<\/li>\n<\/ul>\n<p><strong>Conclusions:<\/strong><\/p>\n<p>TPLF in Italy is a growing sector that, while not yet specifically regulated, is attracting increasing interest among legal and financial practitioners.
