We have also developed significant experience in the area of litigation funding, a phenomenon that is growing rapidly in Italy and is already very relevant abroad. Litigation funding, or the assignment of disputed rights, can be used for individual or recurring cases. The basic concept is that a party may assign the disputed right to damages, without any charge for legal fees or obligation to pay if the claim is unsuccessful. This type of agreement can be combined with pothumous insurance, where the party paysa a premium to secure coverage against the risk of liability for adverse costs in the event of a loss.
